Supreme Court Rules in Favor of Trump Administration in Immigration Judges’ Free Speech Case

The U.S. Supreme Court has ruled in favor of the Trump administration in a case involving free speech restrictions on immigration judges. The court’s decision did not address the legality of the policy’s speech restraint, which was originally implemented in 2017 during Trump’s first term as president.

The policy restricts what immigration judges can publicly say about immigration. The National Association of Immigration Judges had challenged the policy, arguing that it violates their First Amendment right to speak on matters of public concern.

The Supreme Court’s ruling leaves the door open for the association to continue pursuing their legal challenge in a lower court. The court is expected to resolve by the end of June the Trump administration’s argument that removal protections unconstitutionally constrain presidential power.
